Wills are necessary as they clearly state a person’s wishes without any dispute. In the will, the testator may specify how the distribution of his assets will be done.

Importance of registering a will

Wills are legal documents. It is not necessary to register a will. It is better to have a registered will than keep it unregistered. For will registration, stamp duty payable is not applicable. It is a better choice to register the will when the person specifies some instructions that people need to follow after his demise. There will be no doubt or confusion regarding the genuineness of the will.

Cost of registration of a will

Now, writing and making a will has become easy. Almost everyone is familiar with making wills now. You can write them using various online services. You have to get a printout of it and sign it. If you want an experienced lawyer to draft your will, you need to spend around Rs. 10,000 and Rs. 15,000. This is the only cost of registration of a will.

Many people prefer to register their will. Registration of a will does not require any pay stamp, but a registration fee is involved. The will registration fee varies from state to state in India.
There are states where the fee for registering a will is even less than 10 rupees. In some states, this fee is around 100 rupees or above.

Benefits Of Registered Will

  The benefits of having registered will are as follows:

  • No one can damage, steal or tamper with a registered will.
• There is a minimum chance of getting misplaced.
• The registrar keeps the will safely and secretly.
• No person can access, view, or modify the will if the testator does not express permission by writing to the registrar till the testator’s death.
• If it is an uncontested will, it is possible to mutate the leasehold property by taking the names of legal heirs without getting probate of the same.

Disadvantages of Registered Will

  Registering a will also has its demerits:

   • Once you go for the revocation of a registered will, the process may get cumbersome. This case is different for unregistered will.
• Once a registered will gets revoked, you have to register the subsequent one also.
